Democrats are breaking every rule they can.
And one bombshell Supreme Court leak had all hell breaking loose.
For the first time ever a draft Supreme Court opinion leaked.
POLITICO obtained a draft opinion of the court’s ruling in the Dobbs v. Jackson Women’s Health case where the justices heard arguments about Mississippi’s ban on abortions after 15 weeks.
Justice Samuel Alito – writing for the majority – ruled that the court must overturn Roe v. Wade and Casey v. Planned Parenthood – the two decisions legalizing abortion on demand in America.
“We hold that Roe and Casey must be overruled,” Justice Alito allegedly wrote. “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”
Alito expressed the view even held by liberals – including Ruth Bader Ginsburg – that the legal reasoning behind Roe v. Wade was fundamentally flawed.
The last 50 years of judicial confirmation wars were a direct result of the Supreme Court injecting itself into the abortion debate.
“Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division,” POLITICO reported Alito writing.
Alito also explained that Roe invented a right to an abortion that existed nowhere in the Constitution.
“The inescapable conclusion is that a right to abortion is not deeply rooted in the Nation’s history and traditions,” Alito added.
“The Constitution does not prohibit the citizens of each State from regulating or prohibiting abortion,” Alito concluded. “Roe and Casey arrogated that authority. We now overrule those decisions and return that authority to the people and their elected representatives.”
POLITICO reported that four other conservative justices – including all three nominated by President Trump – voted to overturn Roe v. Wade.
“A person familiar with the court’s deliberations said that four of the other Republican-appointed justices – Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett – had voted with Alito in the conference held among the justices after hearing oral arguments in December, and that line-up remains unchanged as of this week,” POLITICO reported.
Either a liberal justice or one of their clerks leaked this draft as a way to create a corporate media pressure campaign to force one of the conservatives to change their votes.
Democrats successfully executed those pressure tactics in 2012 when Chief Justice John Roberts initially voted to rule Obamacare unconstitutional.
Whoever leaked this draft violated constitutional norms, attacked American democracy, and potentially committed a crime.
And it’s all because the left believes killing one million babies a year is the Holy Grail of politics.
Instead, after Obama and other Democrats attacked the court Roberts flipped his vote.
