Former Manhattan District Attorney’s Office prosecutor Mark Pomerantz finally testified before the House Judiciary Committee.
Committee Chairman Jim Jordan subpoenaed Pomerantz as part of the investigation into Bragg weaponizing the criminal justice system to bring a sham indictment against Donald Trump.
After quitting the DA’s office in protest over Bragg not indicting Trump on baseless financial crime charges Pomerantz wrote a book smearing Trump as a criminal, an unheard-of act by a former prosecutor in a country where everyone is entitled to the constitutional presumption of innocence.
The fact that Bragg indicted Trump following the Pomerantz book and Trump announcing a run for re-election made it clear to many Americans that Bragg indicted Trump for political reasons.
Republicans hoped to gain a window into Bragg’s thinking by subpoenaing Pomerantz.
But when Pomerantz finally testified, he would only say “I plead the Fifth” — which is his right under the Constitution — to avoid answering the committee’s questions.
Pomerantz adopted a hostile posture in his opening statement attacking the very legitimacy of the investigation.
“What I do not respect is the use of the Committee’s subpoena power to compel me to participate in an act of political theater,” Pomerantz ranted. “This deposition is for show. I do not believe for a moment that I am here to assist a genuine effort to enact legislation or conduct legislative ‘oversight.’”
“Fortunately, I do not have to cooperate with the cynical histrionics that this deposition represents,” Pomerantz fumed. “Although the rule of law compels me to be here, it does not require that I play a substantive role in your theatrical production. Under the law, I can decline to answer your questions for several reasons.”
California Republican Congressman Darrell Issa blasted Pomerantz as a malcontent out to sabotage the investigation.
“I’ve never had a more obstructive and less cooperative witness in my over 20 years in Congress,” Issa told reporters.
“The witness has not cooperated in any way, shape, or form — has simply appeared. And I would characterize as taking the Fifth on every single question. He has answered no substantive questions whatsoever. And clearly appears unwilling to answer any questions even about previous statements he’s made. He is actually invoking his Fifth Amendment rights, in addition to many others,” Issa continued.
Mark Pomerantz has every right to plead the Fifth.
But the fact that Pomerantz was unwilling to answer simple questions about Bragg’s investigation into Trump led many Americans to believe the indictment did not pass the smell test.
