And now Donald Trump is about to see Joe Biden at the Supreme Court in a major 2020 case.
Nancy Pelosi’s January 6 Select Committee subpoenaed records and documents from Donald Trump from before the 2020 election to early January as part of the Democrats’ attempt to build a narrative that Trump incited the January 6 melee at the Capitol.
Trump refused on grounds of executive privilege.
Joe Biden fears losing to Trump in 2024 and views the committee’s fishing expedition as his best chance to discredit Trump and waived executive privilege on behalf of Trump.
And three Democrat partisans on the D.C. Circuit Court of Appeals – Judge Patricia Millett, Judge Robert Wilkins and Judge Ketanji Brown Jackson – unanimously ruled against Trump.
“The January 6th Committee has … demonstrated a sound factual predicate for requesting these presidential documents specifically,” Judge Millett wrote. “There is a direct linkage between the former President and the events of the day.
“Both Branches agree that there is a unique legislative need for these documents and that they are directly relevant to the Committee’s inquiry into an attack on the Legislative Branch and its constitutional role in the peaceful transfer of power,” Millett continued.
The three Democrat partisans claimed the political motivations of the January 6 committee overrode any claim to executive privilege by Donald Trump.
“We need not conclusively resolve whether and to what extent a court could second guess the sitting President’s judgment that it is not in the interests of the United States to invoke privilege,” the judges added. “Under any of the tests advocated by former President Trump, the profound interests in disclosure advanced by President Biden and the January 6th Committee far exceed his generalized concerns for Executive Branch confidentiality.”
Justices Millett and Wilkins are Obama judges and Jackson is Joe Biden’s lone appointed activist on the three-judge panel selected to hear this case.
Trump’s spokeswoman Liz Harrington released a statement acknowledging that the partisan makeup of the D.C. Court of Appeals made it unlikely a Republican would ever get a fair hearing and that this case would always head to the Supreme Court.
“Regardless of today’s decision by the appeals court, this case was always destined for the Supreme Court,” Harrington wrote. “President Trump’s duty to defend the Constitution and the Office of the Presidency continues, and he will keep fighting for every American and every future Administration.”
This case will test the limits of executive privilege.
And if Joe Biden wins, it may be a victory he comes to regret.
If Donald Trump or another Republican wins in 2024, Republicans will subpoena all of Joe Biden’s records and documents about the withdrawal from Afghanistan, the criminal investigation into Hunter Biden and what White House officials and doctors thought about Joe Biden’s physical and mental health.
