Joe Biden and Kamala Harris made a big mistake.
But Democrats had no idea how catastrophic it was.
That is because Joe Biden just invited the one lawsuit Clarence Thomas could use to destroy him.
Jen Psaki announced the Biden administration demanded Facebook censor posts on their platform to perform Communist Chinese-style speech regulation.
“We’re flagging problematic posts for Facebook that spread disinformation,” Psaki stated.
Psaki announced the administration insisted Facebook take down posts and alter their algorithms to suppress posts about the coronavirus vaccine that contradict the administration’s talking points.
“Facebook should provide, publicly and transparently, data on the reach of COVID-19 vaccine misinformation, not just engagement, but the reach of the misinformation and the audience that it’s reaching,” Psaki added. “That will help us ensure we’re getting accurate information to people. This should be provided not just to researchers but to the public so that the public knows and understands what is accurate and inaccurate.”
Psaki said Facebook must “create a robust enforcement strategy that bridges their properties and provides transparency about the rules,” in order to take “faster action against harmful posts,” and to push “quality information sources in their feed algorithm” into users’ newsfeeds.
The press secretary announced the White House prepared a secret list of 12 accounts that spread “misinformation” and urged Facebook to censor them.
“There’s about 12 people who are producing 65% of anti-vaccine misinformation on social media platforms,” Psaki continued. “All of them remain active on Facebook, despite some even being banned on other platforms, including Facebook, ones that Facebook owns.”
Whenever conservatives attack Big Tech for ideologically motivated censorship, liberals, Never Trumpers, and activists in the corporate media shout that Facebook is a private company not subject to the First Amendment.
But if Facebook censors posts at the behest of the U.S. government, they become a state actor which means they are subject to the Constitution and could be in violation of the First Amendment.
President Trump argued Facebook, Twitter, and Google served as state actors when they banned him because Trump claimed they took down his accounts at the request of Democrat politicians.
Facebook censoring posts at the demand of the Biden administration is a more clear-cut case of a social media company serving as a state actor.
This past April, Clarence Thomas wrote an opinion arguing it was time to regulate Big Tech’s ability to censor users claiming social media platforms were common carriers like the phone company or the United States Postal Service.
Conservatives on the Supreme Court clearly hold some appetite to rein in Big Tech’s ideologically motivated censorship.
Biden’s mistake in ordering social media companies to censor Americans and restrict the flow of information available to the public could open social media giants up to a lawsuit that blocks government-mandated speech controls.
