During his eight-year reign, Barack Obama did everything in his power to implement his agenda.
But in the first two years, President Trump has been making huge strides to reverse it.
And a judge just destroyed Obama’s biggest accomplishment.
Former President Obama ran on an extreme platform, outright embracing socialist policies on issues like healthcare.
And in his first term, he was able to pass his now-infamous Obamacare bill.
While Obamacare isn’t as extreme as Obama would have liked, it still is a massive intrusion into healthcare, and a major leap towards outright socialized medicine.
The most controversial portion of the bill is the individual mandate provision, forcing individuals to purchase healthcare.
And it’s that portion that will likely be its downfall due to a judge’s recent ruling.
A federal judge in Texas has struck down the law due to the individual mandate being unconstitutional.
In response, President Trump tweeted a victorious tweet:
“As I predicted all along, Obamacare has been struck down as an UNCONSTITUTIONAL disaster! Now Congress must pass a STRONG law that provides GREAT healthcare and protects pre-existing conditions. Mitch and Nancy, get it done!”
Former President Obama responded in a Facebook post which in part decries Republican efforts to block his top accomplishment:
“Republicans will never stop trying to undo all that. If they can’t get it done in Congress, they’ll keep trying in the courts, even when it puts people’s pre-existing conditions coverage at risk.”
The former President also used the opportunity to encourage Democrats to vote, urging them “to keep voting, in big numbers, in every election, for people who’ll protect and improve our care.”
But despite a court ruling it unconstitutional, it isn’t dead yet.
It is almost certain to quickly face appeals from a number of Democrat-controlled states.
California Attorney General Xavier Becerra calls the ruling “an assault,” and vows to file an appeal.
In the end, the case will likely end up in the Supreme Court.
The Supreme Court has upheld Obamacare in the past.
But with the new make-up of the Supreme Court, it has a much worse chance than it ever has since its signing.
Since being elected President, Trump has been able to appoint two new Supreme Court Justices.
Justice Neil Gorsuch will almost certainly oppose Obamacare on the Court.
He is known as being in the mold of the late Justice Antonin Scalia, who was loudly in opposition to Obamacare.
But Justice Kavanaugh will be up in the air, with nobody knowing where exactly he stands.
For some, like Fox News legal pundit Judge Andrew Napolitano, they feel that Kavanaugh will be pro-Obamacare.
That is based on a 2011 ruling while he was serving on a D.C. Circuit Court.
In it, Kavanaugh shot down a challenge to Obamacare, on the basis that the Circuit Court was not the avenue for the challenge.
So in reality, there is no real way to know where he will stand, as he has no position.
