Even though her first attempt was a disaster, Nancy Pelosi is trying to impeach Trump again.
But it’s proving harder than she expected.
Nancy Pelosi was furious to discover the status of her Trump impeachment.
On Monday, Reps. David Cicilline (RI), Ted Lieu (CA) and Jamie Raskin (MD) introduced an article of impeachment against President Donald Trump.
The impeachment article reads:
“[I]ncited by President Trump, members of the crowd he had addressed, in an attempt to … interfere with the Joint Session’s solemn constitutional duty to certify the results of the 2020 Presidential election, unlawfully breached and vandalized the Capitol, injured and killed law enforcement personnel, menaced Members of Congress, the Vice President and Congressional personnel, and engaged in other violent, deadly, destructive, and seditious acts.”
What the Democrats are doing is worse than pointless.
Trump urged the protesters to stay peaceful and told them to go home. Claiming that he’s personally responsible for behavior he condemned is legally wrong.
Impeachment is not supposed to be used to create political theatre but that’s what the Democrats have turned it into.
They’re destabilizing the American system in order to try and get a cheap political victory.
Constitutional law scholar Alan Dershowitz told Fox News on Sunday that the impeachment probably won’t even go to trial in the Senate.
“I have got to get your thoughts on this 25th Amendment or this impeachment. House Democrats have drafted articles of impeachment they will introduce on Monday if the president doesn’t resign,” host Maria Bartiromo said. “Tell me your reaction to this. Will you defend this in court if it goes to trial?”
“It will not go to trial,” Dershowitz responded. “All the Democrats can do is impeach the president in the House of Representatives. For that, all you need is a majority vote. You don’t have to take evidence. There are no lawyers involved. But the case cannot come to trial in the Senate, because the Senate has rules. And the rules would not allow the case to come to trial until — according to the majority leader until 1:00 p.m. on January 20, an hour after President Trump leaves office. And the Constitution specifically says, the president shall be removed from office upon impeachment, et cetera.
“It doesn’t say the former president. Congress has no power to impeach or try a private citizen, whether it be a private citizen named Donald Trump or named Barack Obama or anyone else. The jurisdiction is limited to a sitting president. And so there won’t be a trial.”
The danger is that the Democrats are impeaching Trump for exercising his freedom of speech.
Protecting the Constitution is more important than a few short-term gains.
The majority of Americans can agree that the violence at the Capitol was wrong yet the Democrats are using the incident to divide America even further.
