Ever since Donald Trump was elected president, former President Obama has been looking for ways to defy him.
While former presidents don’t usually do that, President Trump is such a threat to the establishment that anybody on the inside hates him.
And in a shocking move, Obama just scored a disgusting anti-Trump win in federal court.
Obama’s Dishonest Bill Names
When crafting legislation, former President Obama was famous for crafting bill names that don’t describe what the legislation actually does.
He passed the “Affordable Care Act,” which made healthcare more expensive and less reliable for millions of Americans.
So when he touts the “Clean Water Act,” you can be sure that it isn’t just about clean water.
In this specific case, the Clean Water Act was actually 70’s era law which expanded Environmental Protection Agency (EPA) powers on U.S. waters.
But during the Obama era, that bill was expanded to give the EPA the authority to regulate seasonal and relatively insignificant bodies of water.
That one change angered many farmers and ranchers and was strongly opposed by agriculture interest groups as it was an undue burden on many landowners who have never had to deal with the EPA interfering with their property over small bodies of water.
In one case, a California farmer was fined $2.8 million after being caught plowing over vernal pools, which are simply small seasonal lakes or puddles, but because of the Obama-era regulations on the Clean Water Act, he was in violation.
So when President Trump took office, this was an issue he chose to tackle.
Scalia’s Opinion Matters To Trump
In February of 2017, President Trump signed an executive order to review the Obama-era expansions to the Clean Water Act.
Trump stated that the rule should be changed to be “consistent with the opinion of Justice Antonin Scalia in Rapanos v. United States.”
The late Justice Scalia felt that the Obama-era expansion was too far-reaching, and through Trump’s executive order the law would become much less onerous on farmers and ranchers across the country.
But while Trump’s former EPA Administrator Scott Pruitt began making moves towards changing the rule, starting with staying the rule until 2020, a federal judge in South Carolina began to take notice.
An Injunction Against The Trump Administration
Last week that federal judge in South Carolina chose to file an injunction against the Trump administration on this issue, lifting the stay imposed by Pruitt.
That means that the Obama-era rule will stay in effect and that the EPA will remain with the extreme authority they were granted.
This is bad news for Trump, but with the Supreme Court siding with him more and more, it could just be a temporary problem.
While Obama’s rule has won, for now, it very likely won’t last.
Federal courts have been extremely harmful to Trump since he took office.
After implementing his travel ban, it was a federal court that continually blocked him.
But eventually, it made its way to the Supreme Court where Trump gained a solid win.
This could end the same way.
