After the riot at the Capitol, Chuck Schumer saw a chance to plot with Never Trump RINOs like Mitt Romney and convict Donald Trump on the House’s article of impeachment.
But they never saw this defeat coming.
That’s because Rand Paul said three words about impeachment that had all hell breaking loose.
Kentucky Senator Rand Paul blew up impeachment by forcing a procedural vote on dismissing the article of impeachment against Donald Trump because it is unconstitutional to hold a trial for a president once they leave office.
The Constitution states that the chief justice will preside over the trial for the president.
Donald Trump is not the President and Chief Justice Roberts is not presiding over this trial.
A plain reading of the Constitution favors Senator Paul’s position.
Forty-four other Republicans agreed with just five Never Trump traitors—Mitt Romney, Ben Sasse, Lisa Murkowski, Susan Collins, and Pat Toomey—joining the Democrats to table Paul’s motion.
But even though Paul’s motion failed 55-45, Senator Paul declared voting showed that impeachment was “dead on arrival” because no Republican could claim the proceeding was unconstitutional and then vote to convict the President in a trial they already deemed illegal.
“If you voted that it was unconstitutional then how in the world would you ever hope to convict somebody for this?” Paul reasoned, adding that, “45 of us, almost the entire caucus, 95% of the caucus, voted that the whole proceeding was unconstitutional. This is a big victory for us. Democrats can beat this partisan horse as long as they want — this vote indicates it’s over, the trial is all over.”
Even the RINOs wanting to expel Trump from the GOP admitted defeat.
“Do the math,” Collins told the press after resigning herself to defeat on convicting Trump. “I think it’s extraordinarily unlikely that the President will be convicted.”
Texas Senator John Cornyn also acknowledged the reality of the situation.
“I don’t think Democrats expect to have the votes to convict,” Cornyn stated. “I don’t think this is about accomplishing that. I think this is an effort to embarrass not only the former president but also members of the opposing party.”
But RINO turncoat Senator Mitt Romney refused to admit defeat and concede that the truth of the matter was that Romney was on the wrong side of the law and history.
Romney falsely claimed “the preponderance of opinion with regards to the constitutionality of a trial of impeachment of a former president is saying that it is a constitutional process.”
That is not true.
Romney’s dubious comments came after George Washington University Law Professor Jonathan Turley spoke to the Senate Republican Caucus where he laid out his views on the matter that Trump did not break any laws.
According to Senator Paul, Turley “said there’s not a chance in hell that you could convict Donald Trump in any court in the land of incitement.”
Romney and other RINOs hoped to exploit impeachment to rid the party of Donald Trump.
That effort ended in spectacular failure with 45 Republicans voting to dismiss the impeachment trial as unconstitutional.
