Donald Trump is hoping the Senate confirming Amy Coney Barrett will cement a conservative majority on the Supreme Court.
But now one key insider is raising the alarm.
And now this top senator had bad news for Donald Trump about the Supreme Court.
Florida Senator Marco Rubio was the latest to weigh in on Joe Biden and Kamala Harris refusing to reveal their position on the demand by many Democrats to pack the Supreme Court with liberal justices if Joe Biden wins the election on November 3.
Speaking to Fox News Channel’s Jesse Watters, he said that Biden would not state his position on court-packing because Biden supported the unpopular scheme.
Rubio explained that Biden would have no choice but to support court-packing because the energy on the left – as evidenced by the fundraising and grassroots activism – is with the far-left.
“Look, the answer to the question is yes,” Rubio told Watters. “And the reason why — here’s what I honestly believe — I think Joe Biden, because he’s been there so long he’d prefer not to, but he has no choice, because all the energy, all that money, all the activism in the Democratic Party is coming from the far left and they’ve been talking about and insisting on this for a very long time.”
Rubio added that the Democrats packing the court in 2021 would lead to an arms race style competition where Republicans would retaliate the next time they controlled the White House and the Senate and then would continue in tit for tat fashion.
“And I want people to understand this is not going to end at nine,” Senator Rubio added. “We could have a Supreme Court one day with 15 or 18 people, 19 people. Every time some party gets elected and you don’t like the makeup of the court you just add two more people to it. I mean, that’s what they do in the third world. It would be ridiculous.”
The only way Democrats could pack the court is if Democrats win control of the Senate and eliminate the filibuster.
Rubio warned that the consequences of the Democrats erasing the filibuster would not end with court-packing.
Senator Rubio said the Founders envisioned the Senate as a check on the majority rules House of Representatives and “most certainly wanted the Senate to act as the body that sort of slowed things down so that we took some time to analyze situations.”
“And that’s why it’s tough to get things passed in the Senate, and I think the filibuster has been used by both parties,” Rubio added.
But Rubio predicted that if Democrats eliminated the filibuster, they would also move to impose a job-killing cap-and-trade and scheme a government takeover of health care.
And once Democrats pack the Supreme Court, any legal challenges to this radical legislative agenda will fall on deaf ears.
