Liberals fought tooth and nail to stop Neil Gorsuch and Brett Kavanaugh’s confirmations to the Supreme Court because the left feared defeat on every legal front.
Now one of the biggest cases ever is about to find its way in front of the justices.
And the Supreme Court will make one ruling that will leave everyone’s jaw on the ground
After the landmark Heller and McDonald decisions that struck down handgun bans and established once and for all that the right to keep and bear arms was a fundamental right the Supreme Court steered clear of Second Amendment cases.
That could be about to change.
Justices Neil Gorsuch and Brett Kavanaugh shifted the court to the right.
Firearms manufacturer Remington Arms recognizes the new reality on the Supreme Court and is asking for relief in a case that could destroy the Second Amendment.
The parents of the victims in the 2012 Sandy Hook tragedy sued Remington Arms because the weapon the madman used, a Bushmaster XM15-E2S – or an AR-15 – rifle was manufactured by the company to carry out his act of murder.
A state judge in Connecticut threw the case out but families of the victims appealed.
In a 4-3 decision, the State Supreme Court of Connecticut ruled the case could go forward.
The company appealed and asked the Supreme Court to decide the matter.
Scott Keller and Stephanie Cagniart – the lawyers for Remington – argued that lawsuits against gun makers were unconstitutional and run around the Second Amendment’s protection of the right to keep and bear arms.
“Congress enacted the (law) to ensure that firearms — so central to American society that the Founders safeguarded their ownership and use in the Bill of Rights — would be regulated only through the democratic process rather than the vagaries of litigation,” Keller and Cagniart argued.
Currently, the Protection of Lawful Commerce in Arms Act prevents gun manufacturers from being liable for when an individual commits a criminal act with one of their firearms.
But this case threatens to permanently end the Second Amendment in America as everyone knows it.
If victims of gun violence can sue manufacturers because madmen commit crimes using guns then gun manufacturers will go out of business.
The right to keep and bear arms will remain in the Constitution but the threat of lawsuits will render it effectively useless as there will be no way for Americans to exercise that right.
Conservatives turned out in record numbers to make sure Donald Trump – and not Hillary Clinton – was the one appointing Supreme Court Justices.
The President rewarded that faith by appointing Neil Gorsuch and Brett Kavanaugh to the nation’s highest court.
Donald Trump’s Supreme Court nominees proved to be two of the biggest victories in the President’s first term.
And now they are all that is standing in between Americans and a complete gutting of the Second Amendment.
