There was a bombshell leak at the Supreme Court.
The leaker may have committed a serious crime.
And the Supreme Court is about to demand the FBI do one thing that will make Democrats sweat.
Someone inside the Supreme Court leaked a draft of Justice Samuel Alito’s opinion overturning Roe v. Wade.
Justice Alito’s ruling – joined by Justices Clarence Thomas, Neil Gorsuch, and Amy Coney Barrett – dismantled the weak and faulty reasoning of the original Roe v. Wade case calling the 1973 decision imposing abortion on demand across the entire nation “egregiously wrong.”
But this is just a draft opinion.
The court hasn’t struck down Roe v. Wade yet.
Instead, the real story was the leak of the draft opinion which amounted to a surgical strike on the legitimacy of the Supreme Court and an attempt to pressure one of the conservative justices to uphold Roe.
Never before can anyone remember a draft opinion leaking.
The leaker fed this opinion to the press to attack the decision to overturn Roe, destroy trust within the court, and eliminate the ability of the court to operate as a functioning institution.
Even center-left Chief Justice John Roberts – who is voting to uphold Roe v. Wade – released a statement expressing outrage and as well as an investigation.
“This was a singular and egregious breach of that trust that is an affront to the court and the community of public servants who work here,” Chief Justice Roberts’ statement read.
Chief Justice Roberts pledged – most likely in futile fashion – that this leak would not affect the way the court conducted its business.
“The work of the court will not be affected in any way,” Roberts added. “We at the court are blessed to have a workforce — permanent employees and law clerks alike — intensely loyal to the institution and dedicated to the rule of law. Court employees have an exemplary and important tradition of respecting the confidentiality of the judicial process and upholding the trust of the court.
“I have directed the marshal of the court to launch an investigation into the source of the leak,” Roberts concluded.
Former federal prosecutor Andy McCarthy outlined the potential crimes the leaker committed.
“These are government records. All the people who work at the Supreme Court, they’re not private actors. They’re all government officials: the justices, the clerks who work for them, their staff, support staff at the court,” McCarthy explained.
“The materials they work with are government records. If you embezzle a government record, that’s a federal crime,” McCarthy stated.
“If you convert it to your own use, that’s a federal crime. If you obstruct a judicial proceeding, it’s a federal crime,” McCarthy declared.
This leak was clearly intended to terrorize the justices.
Within hours of POLITICO publishing Alito’s opinion, a mob descended on the Supreme Court cursing the justices and creating an atmosphere threatening violence.
The leaker hoped to bully the justices into keeping Roe on the books.
But now, will this leaker pay a price by facing criminal charges?
