They’ve thought up an extraordinary plan to stop Donald Trump.
Democrats have a new strategy to keep Donald Trump from being reelected and it’s shocking.
Numerous Democrats are now advocating the scheme of refusing to certify Donald Trump if he wins the presidency by citing the former President as an insurrectionist.
Reps. James Clyburn (SC), Jamie Raskin (MD), Adam Schiff (CA), Eric Swalwell (CA), and House Minority Leader Hakeem Jefferies have all declined to say whether they’d confirm Trump to office if he wins the 2024 election.
A piece published in The Atlantic on Friday pushed the idea that Democrats could deny Trump the presidency.
The article, written by Russell Berman, said, “…legal scholars say that, absent clear guidance from the Supreme Court, a Trump win could lead to a constitutional crisis in Congress. Democrats would have to choose between confirming a winner many of them believe is ineligible and defying the will of voters who elected him.”
He claimed if the Supreme Court didn’t weigh-in on whether Trump violated the 14th amendment or not, Democrats could use that as justification not to certify the election.
Berman continued: “In interviews, senior House Democrats would not commit to certifying a Trump win, saying they would do so only if the Supreme Court affirms his eligibility. But during oral arguments, liberal and conservative justices alike seemed inclined to dodge the question of his eligibility altogether and throw the decision to Congress.”
Rep. Zoe Lofgren (D-Calif.) responded to The Atlantic’s article saying she’s “confident that Mr. Trump engaged in insurrection” and that she “would consider objecting to the electoral vote certification under the Electoral Count Act if the Supreme Court rules that the 14th Amendment required such action.”
As Dan McLaughlin, senior writer for the National Review, wrote on Friday, Democrats could potentially have the votes to carry out such a plan.
“Only a simple majority is required, and unlike when the House chooses a president under the Twelfth Amendment, they don’t vote by states,” he wrote. “Unlike in 2016 or 2004, when they were in the minority, House Democrats could be playing with live ammunition.”
However Democrats would have an uphill battle to get 51 Senators to vote for such a scheme.
McLaughlin pointed out, “[they would] either have to hold every seat they currently occupy (good luck in West Virginia), or take a Republican-held seat (the bluest of which is either Ted Cruz’s in Texas or Rick Scott’s in Florida).”
