The Supreme Court just gave Donald Trump a huge victory that could upend everything.
The U.S. Supreme Court ruled unanimously on Monday that Colorado cannot disqualify former President Donald Trump from appearing on the 2024 ballot.
“BIG WIN FOR AMERICA!!!” Trump said in a post to Truth Social.
The Supreme Court ruled that Congress, rather than the states, has the power to enforce Section 3 of the 14th Amendment.
“Because the Constitution makes Congress, rather than the States, responsible for enforcing Section 3 against federal officeholders and candidates, we reverse,” the court’s ruling stated.
The justices noted their anxiety about a “patchwork” of outcomes which could result from states unilaterally deciding to throw candidates off the ballot, saying that an “evolving electoral map could dramatically change the behavior of voters, parties, and States across the country, in different ways and at different times.”
“Nothing in the Constitution requires that we endure such chaos—arriving at any time or different times, up to and perhaps beyond the Inauguration,” they wrote.
All nine justices agreed on the verdict that states cannot throw federal candidates off the ballot.
However Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson dissented from the majority.
“Although we agree that Colorado cannot enforce Section 3, we protest the majority’s effort to use this case to define the limits of federal enforcement of that provision,” the trio wrote.
“Because we would decide only the issue before us, we concur only in the judgment,” the three Democratic-appointed justices wrote in their concurrence.
Justice Amy Coney Barrett also wrote separately to state that amid settling “a politically charged issue in the volatile season of a Presidential election,” the Court’s writing “should turn the national temperature down, not up.”
“For present purposes, our differences are far less important than our unanimity: All nine Justices agree on the outcome of this case,” she wrote. “That is the message Americans should take home.”
Colorado Secretary of State Jena Griswold expressed her displeasure at the Supreme Court’s ruling against her state’s disqualification of Trump.
“My larger reaction is disappointment. I do believe that states should be able under our constitution to bar oath-breaking insurrectionists. And ultimately this decision leaves open the door for Congress to act, to pass authorizing legislation,” Griswold told MSNBC’s Katy Tur Monday. “But we know that Congress is a nearly non-functioning body. So ultimately, it will be up to the American voters to save our democracy in November.”
