A federal judge has blocked the Biden administration from contacting social media companies after the White House coordinated with Facebook to censor posts, including a video by Tucker Carlson, that were not in violation of the platform’s content policy.
Judge Terry Doughty of U.S. District Court for the Western District of Louisiana Monroe Division made the preliminary injunction in response to a lawsuit from the Attorneys General in Missouri and Louisiana.
“The Court has granted our motion to BLOCK top officials in the federal government from violating the First Amendment rights of millions of Americans,” Missouri Attorney General Andrew Bailey tweeted. “What a way to celebrate Independence Day.”
The lawsuit stemmed from the White House’s efforts to suppress information that didn’t align with the Democrats’ Covid narrative.
Deputy Assistant to the President and Director of Digital Strategy Rob Flaherty emailed Facebook in March 2021, demanding that a video from Tucker Carlson be censored.
On the same day, then-White House advisor Andy Slavitt emailed Facebook executive Nick Clegg about Carlson’s “anti-vax message.”
“Not for nothing but the last time we did this dance, it ended in an insurrection,” Slavitt said, according to court filings.
“Clegg responded with a detailed report about Carlson’s post and said the video was being ‘demoted’ despite, according to Clegg, it not violating Facebook’s content policy on COVID-19 vaccines. Facebook also attached a label to the video with authoritative COVID information and did not recommend it to users,” the Daily Caller reported.
Facebook allegedly demoted the video by fifty percent for seven days at the behest of the Biden White House.
“Facebook noted that in response to White House demands, it was censoring, removing, and reducing the virality of content discouraging vaccines ‘that does not contain actionable misinformation,’” Judge Doughty wrote.
The order currently prohibits federal agencies and government officials from pressuring social media companies “in any manner” to suppress points of view they disagree with.
A White House official says the Justice Department is reviewing the decision.
“DOJ is reviewing the court’s injunction and will evaluate its options in this case.”
“This administration has promoted responsible actions to protect public health, safety, and security when confronted by challenges like a deadly pandemic and foreign attacks on our elections. Our consistent view remains that social media platforms have a critical responsibility to take account of the effects their platforms are having on the American people, but make independent choices about the information they present,” the official said.
